Terms of Service
Introduction These Terms of Service ("Terms") govern your use of the services, courses, training programmes, resources, website content and related materials provided by Pcplanttraining.co.uk ("we", "us", "our", "Pc Plant Training"). By accessing or using our services you agree to be bound by these Terms. If you do not accept these Terms you must not use our services.
Definitions
Client or Learner: any individual or organisation receiving or enrolled in our training services.
Services: all training courses, classroom or on-site instruction, e-learning, assessments, certification support, consultancy and any other related services we supply.
Contract: the agreement between you and us for the provision of Services, formed as set out in clause 4.
Eligibility You must be at least 18 years old and capable of entering into a binding contract to use our Services. Organisations using our Services warrant that they have authority to enter into these Terms.
Formation of Contract A Contract is formed when we accept your booking or enrolment, either by email, written confirmation, or payment confirmation, and you receive a booking reference. Any quotes we provide are valid for the period stated on the quote, otherwise for 30 days.
Fees and Payment
Fees for Services are as quoted in writing or on our website at the time of booking. All fees are exclusive of VAT unless stated otherwise.
Payment terms will be as stated on the invoice. If no terms are stated, payment is due within 14 days of invoice date.
We reserve the right to suspend or cancel Services where payment is overdue.
If you dispute a charge you must notify us in writing promptly and in any event within 14 days of the invoice date. You remain responsible for all undisputed amounts.
Cancellation, Transfer and Rescheduling
Client cancellations for scheduled courses: written notice is required. Cancellation charges apply as follows unless otherwise agreed in writing:
More than 30 days before course start: full refund minus any non-refundable administration fees.
15–30 days before course start: 50% of the course fee.
Less than 15 days before course start: 100% of the course fee.
For bespoke or on-site courses, cancellation charges may be higher to cover preparatory costs; specific terms will be set out in the quote or Contract.
Transfers: You may transfer booking names for an agreed course without additional charge up to 7 days before the course start date. Transfers within 7 days may incur an administrative charge.
Rescheduling by us: we will endeavour to run all scheduled courses. Where rescheduling is necessary we will give you as much notice as reasonably practicable and offer alternative dates or a full refund.
Course Materials and Intellectual Property
All course materials, documentation, assessments and other resources provided by us remain our intellectual property or the property of our licensors.
You are granted a non-exclusive, non-transferable right to use materials for your own internal training and development only. You must not copy, reproduce, distribute, modify, publish or create derivative works from materials without our prior written consent.
Learner Conduct and Health & Safety
Learners must comply with all instructions given by trainers and any site-specific health and safety requirements.
Where practical elements are included (plant operation, streetworks exercises) learners must disclose any medical condition, medication or disability that may affect safe participation. We may require medical clearance before allowing participation.
We reserve the right to suspend or exclude any learner whose behaviour poses a risk to themselves, other learners, staff or property. No refund will be provided in such circumstances.
Assessments and Certification
Successful completion of a course may require attendance, participation, assessment and/or practical demonstration as specified for the course.
We endeavour to process assessments and issue certificates promptly. Certificates remain our property or the awarding body’s property and must be returned if requested in the event of error or fraud.
Misuse, falsification or fraudulent presentation of certificates or assessment results is prohibited. We may investigate and report suspected fraud to relevant authorities and awarding organisations.
Training Equipment and Facilities (On-Site)
For on-site training you must provide access to suitable facilities, plant, equipment, PPE and utilities as agreed prior to delivery. Failure to provide agreed facilities may result in additional charges or cancellation.
We will ensure our trainers bring suitable tools, materials and risk assessments required for delivery.
Data Protection and Privacy
We process personal data in accordance with applicable data protection law. Our Privacy Policy sets out how we collect, use and store personal data. By using our Services you consent to such processing.
We may share learner data with awarding bodies or certification bodies where necessary to administer assessments and certification.
